Course Details

The best interests assessor intensive course provides you with the training and education to undertake the role of a best interests assessor in Wales.

The Mental Capacity Act 2005 Deprivation of Liberty Safeguards were introduced following a decision of the European Court of Human Rights in HL v United Kingdom (45508/99) (2005) 40 EHRR 32. They provide an administrative framework for the authorisation of the deprivation of the liberty of an adult who lacks capacity in a hospital or care home. The framework requires independent assessments by a Best Interests Assessor to confirm that the relevant person meets the requirements to be a detained patient.

While it is for Supervisory Bodies in Wales to determine what training, if any, they require best interests assessors to have undertaken this course will enable you to satisfy supervisory bodies that you are able to discharge the role to the standards required by the Mental Capacity (Deprivation of liberty: Assessments, Standards Authorisations and Disputes about residence) (Wales) Regulations 2009.
